Document All Damage Upon Moving In

When you move into your new apartment, carefully document all damage and imperfections within the unit itself. If your landlord doesn't give you a damage documentation form, then create one yourself. Make note of any and all damage, no matter how seemingly insignificant. You may also want to take pictures of the damage for future reference. Sign the damage form when you've completed it and send a copy to your landlord to sign.

Schedule a Walk-Through With Your Landlord

When you move out of your apartment, it's a good idea to request a walk-through with your landlord. During this walk-through, both you and your landlord should have access to a copy of your damage documentation form. This way, your landlord can distinguish existing damage from damage that you may have caused and charge you accordingly. Know Your Rights as a Renter

If for whatever reason your landlord decides to withhold any of your damage deposit, understand that you have rights as a renter or previous tenant. Fight Charges You Believe to Be Bogus

Finally, if you're having part (or all) of your deposit withheld for reasons you don't agree with, don't hesitate to dispute them. You can take your landlord to small claims court and, if you win, may even be able to receive compensation for your court fees as well.
